Confusion after MCSK disowns notice saying Ezekiel Mutua out as boss

Confusion has erupted following the circulation of conflicting reports about the current role of Ezekiel Mutua at the Music Copyright Society of Kenya (MCSK).

A public notice published in the Daily Nation and signed by individuals identifying themselves as the MCSK Board of Directors claimed that Mutua was no longer serving as CEO.

According to the notice, his tenure at the organization officially ended on May 3, 2025.

The statement further warned the public against conducting any business with Mutua, alleging that he had failed to return several items belonging to the society after his departure.

The notice stated, in part: "Ezekiel Mutua no longer holds any authority to act on behalf of MCSK in any capacity. Members of the public are therefore urged to exercise CAUTION and remain ALERT when engaging with him."

The notice further emphasized: "MCSK hereby issues a DISCLAIMER and shall not accept any responsibility for loss, damage, or harm arising from any dealings with Ezekiel Mutua."

It also accused Mutua of holding onto company property following his alleged dismissal.

Specifically, he was said to have failed to return a black Toyota Prado TX, registration number KDK 158X, as well as access to all official MCSK social media accounts.

Interestingly, a separate statement soon followed—this time expressing support for Mutua and contradicting the earlier announcement.

The second notice, sharply critical of the earlier newspaper publication, firmly asserted that Dr. Ezekiel Mutua remained the duly appointed CEO of the Music Copyright Society of Kenya.

It dismissed the previous claims as "false and malicious," attributing them to former board members whose terms had officially ended on February 16, 2025.

"We wish to clarify unequivocally that these allegations are entirely baseless. Dr. Ezekiel Mutua remains the legitimate CEO of MCSK," it read.

"The individuals behind the earlier notice are former directors who no longer have any legal mandate to represent or act on behalf of the Society."

The new statement went further, revealing that the dispute stemmed from Dr. Mutua’s refusal to authorize payment of over KSh200 million in what the former directors claimed were outstanding arrears owed to them upon their exit from office.

The public was urged to disregard what the notice described as deliberate misinformation.

"These individuals are misrepresenting themselves with the intention of misleading stakeholders and disrupting MCSK operations," it noted.

Signed by Ephantus Wahome Kamau, the MCSK National Chairman, the statement reaffirmed the current board’s unwavering support for Mutua, lauding his leadership as exemplary.

It cited official records (CR12) recognizing the current board’s legitimacy and highlighted that Mutua’s contract had been renewed after he was rated “Excellent” in his final performance evaluation.

The statement concluded with a stern warning to the Daily Nation, demanding a public apology for publishing the earlier notice, and threatened legal action for defamation if the apology was not issued.

Dr. Ezekiel Mutua was appointed CEO of the Music Copyright Society of Kenya in March 2022, following a competitive selection process.

Prior to this role, he served as the CEO of the Kenya Film Classification Board (KFCB) until August 2021.
